A Significant Step: In a crucial development, the Hon’ble Armed Forces Tribunal (AFT), Kolkata, issued a notice to the government on 29 Feb 2024, seeking answers regarding the omission of Group X Pay at the rate of ₹6200 (wef 01.01.2016) for retirees before 2016, as per the Seventh Pay Commission Order.

As per government decision, this pay revision was settled to be effective from 01 Jan 2016, applicable to both current servicemen as well as those who retired from the armed forces before 2016. Surprisingly, retirees from pre-2016 have yet to receive this benefit for reasons unknown.

Several individuals and organizations had filed petitions before the Supreme Court and AFT on this matter. Unfortunately, these petitions were dismissed on technical grounds, citing deficiencies in technical points and documentary evidence. Notably, even cases like Bachan Singh vs UOI did not succeed due to the absence of crucial documents before the Hon’ble AFT.

The issuance of the Hon’ble AFT, Kolkata notice brings a glimmer of hope for pre-2016 retirees. The notice demands the government to present its stance on why the Group X Pay, as per the Seventh Pay Commission Order, has not been extended to retirees before 2016.

This issue highlights the importance of meticulous preparation and presentation of legal cases, ensuring that all necessary technicalities are addressed.
